Please read these Terms and Conditions ("Terms") carefully before using the xopet mobile application (available on iOS and Android) or website (collectively, the "Service"). By downloading, installing, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By creating an account or using xopet, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them and our Privacy Policy. If you are between 13 and 18 years of age, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
Subject to your compliance with these Terms, xopet grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the xopet mobile application on a device that you own or control, solely for your personal, non-commercial purposes.

xopet is a pet management application that allows users to create pet profiles, track health records, log daily check-ins, store photos in a memory journal, and manage other pet-related information. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of it at any time without prior notice.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

You retain full ownership of the content you upload to xopet — including pet photos, health records, check-in logs, and journal entries ("User Content"). By uploading User Content, you grant xopet a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely to operate the Service for you.

We do not monitor User Content routinely, but reserve the right to remove content that violates these Terms.
Certain features of xopet may require a paid subscription. Subscription pricing, features, and billing frequency are displayed within the app prior to purchase.
xopet is a record-keeping and organisational tool for pet owners. It is not a veterinary service and does not provide medical or health advice of any kind. Nothing in the Service — including any health records, reminders, or other features — should be construed as professional veterinary advice, diagnosis, or treatment.
Always consult a qualified, licensed veterinarian for advice regarding your pet's health, diagnosis of illness, or treatment options. In an emergency, contact your local veterinarian or emergency animal clinic immediately.
All content, features, and functionality of the Service — including the xopet name, logo, design, text, graphics, user interface, and underlying software — are the exclusive property of xopet and are protected by applicable intellectual property laws. No part of the Service may be copied, reproduced, distributed, or used for commercial purposes without our prior written permission.
If you download the xopet iOS app from the Apple App Store, you acknowledge that:
If you download the xopet Android app from the Google Play Store, your use is also subject to Google Play's Terms of Service.
We may release updates to the xopet app from time to time. Updates may be required to continue using the Service or to access certain features. We recommend keeping the app updated to the latest version available on your app store.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any data stored through the Service will not be lost.
To the fullest extent permitted by applicable law, xopet and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, including loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to xopet in the 12 months preceding the claim, or (b) INR 500.
You agree to indemnify, defend, and hold harmless xopet and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our discretion. Upon termination, your licence to use the app ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
You may terminate your account at any time by deleting it within the app (Settings → Account → Delete Account) or by contacting us at akshay@xopet.in.
We may revise these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by sending an in-app notification or email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.
